Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale (T&C) govern the contractual relationship between MARAZ Origins (hereinafter "MARAZ" or "we"), a premium African leather goods brand with its headquarters in Dakar, Senegal, and any individual or legal entity (hereinafter "the Customer" or "you") wishing to make a purchase on the marazorigins.com website.

These T&C apply to all product sales made by MARAZ Origins through its website. They are accessible at any time on our site and will take precedence over any other document.

By placing an order on our site, you acknowledge having read these T&C and accept them without reservation. These conditions may be supplemented by specific conditions mentioned on the site when placing your order.

2. Acceptance of terms

Acceptance of these T&C is materialized by a checkbox during the ordering process. Checking this box constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.

The Customer declares having full legal capacity to commit under these T&C. If you are ordering on behalf of a business or organization, you declare having the necessary authority to bind that entity.

We reserve the right to refuse any order from a Customer with whom there is a dispute relating to payment of a previous order or who presents fraudulent behavior.

3. Orders

To place an order, the Customer must follow the online process on our website. All orders are subject to product availability. We reserve the right to refuse or cancel any order in exceptional circumstances, particularly in case of obvious error in price or product description.

Once the order is validated and payment accepted, you will receive a confirmation email summarizing your order. This confirmation constitutes acceptance of your order by MARAZ Origins and formation of the sales contract.

You can cancel or modify your order within 2 hours of validation by contacting us immediately at contact@marazorigins.com. After this period, your item is being prepared and can no longer be modified.

Our products are handcrafted by talented artisans. Production times can vary from 3 to 10 business days depending on the complexity of the piece and our workload. This time is added to the delivery time.

4. Prices and payment

All prices displayed on our site are indicated in CFA Francs (XOF) and Euros (EUR), all taxes included (TTC). Prices may vary depending on the selected currency and the current exchange rate. For international deliveries, customs duties and local taxes may apply and remain the responsibility of the Customer.

MARAZ Origins reserves the right to change its prices at any time. However, products will be invoiced at the price in effect at the time of order validation, subject to availability.

Payment of the full price must be made when ordering. We accept payment by credit card (Visa, Mastercard, American Express), PayPal, bank transfer and, for certain areas in West Africa, cash on delivery and Mobile Money (Orange Money, Wave, Free Money).

All transactions are secured by SSL encryption. We do not keep any banking data on our servers. Payments are processed by PCI-DSS certified providers.

In case of refused payment or proven fraud, your order will be automatically canceled and we reserve the right to initiate legal proceedings.

5. Shipping

MARAZ Origins delivers throughout West Africa and internationally. Shipping costs and times vary by destination and are clearly indicated during the ordering process.

For Senegal: free delivery for any order of 50,000 FCFA or more. Dakar: 3,000 FCFA (2-4 business days). Other regions: 5,000 FCFA (3-7 business days).

For West Africa: fees from 8,000 FCFA, delivery times 3 to 7 business days. For international (Europe, America, Asia): fees calculated at checkout according to weight and destination, delivery times 10 to 21 business days.

Delivery times are given as an indication and may vary depending on customs, weather conditions or exceptional circumstances. MARAZ Origins cannot be held responsible for delivery delays due to these factors.

Upon receipt of your package, we recommend checking its condition and contents. In case of damaged package or missing product, contact us immediately at contact@marazorigins.com with photos.

6. Returns and refunds

In accordance with the right of withdrawal, you have a period of 14 calendar days from receipt of your order to return any item that does not suit you.

To be eligible for return, the item must be in its original condition, unused, unworn, with all tags attached and in its original packaging. Personalized, engraved or custom-made items cannot be returned.

To initiate a return, log into your account, go to "My Orders" and follow the return procedure. You will receive an email with detailed instructions and the return address.

Return costs are your responsibility, unless the item is defective or an error on our part is proven. We recommend shipping with tracking and insurance for valuable items.

Once the item is received and inspected (2 to 5 business days), we will process the refund within 7 to 10 business days to the payment method used when ordering. You will receive a confirmation email once the refund is processed.

7. Warranties

All MARAZ Origins products are guaranteed against manufacturing defects for a period of 12 months from the date of purchase. This warranty covers hidden defects and defects in materials or manufacturing under normal use conditions.

The warranty does not cover normal wear and tear, damage resulting from inappropriate use, accident, negligence, unauthorized modification or inadequate maintenance.

In case of defect covered by warranty, we undertake to repair or replace the defective item free of charge. If repair or replacement proves impossible, we will proceed with a full refund.

To claim your warranty, contact our customer service at contact@marazorigins.com with your order number, a description of the defect and photos. We will tell you what to do.

Leather being a natural material, slight variations in color, grain and texture between items and compared to site photos do not constitute a defect and are part of the authenticity of our artisanal products.

8. Intellectual property

All content on the marazorigins.com site, including but not limited to texts, images, photographs, logos, videos, icons, sounds and software, is the exclusive property of MARAZ Origins or its partners and is protected by international intellectual property laws.

Any reproduction, representation, modification, publication, adaptation, transmission or total or partial exploitation of the content of this site, by any process whatsoever, without the prior written authorization of MARAZ Origins, is strictly prohibited and would constitute counterfeiting sanctioned by articles L. 335-2 and following of the Intellectual Property Code.

The trademarks, logos and distinctive signs of MARAZ Origins are registered trademarks. Any unauthorized use of these trademarks or any other content of the site is likely to give rise to legal proceedings.

The Customer is granted a limited, non-exclusive, non-transferable and revocable license to access and use the site for personal and non-commercial purposes.

9. Liability

MARAZ Origins undertakes to make its best efforts to ensure access to the site, product availability and accuracy of the information presented. However, we cannot guarantee that the site will be free of interruptions, errors or viruses.

We disclaim any responsibility for direct or indirect damages resulting from use of the site or inability to access it, including losses of profits, clientele or data.

Our liability is limited to the total amount of the order concerned. In no event shall MARAZ Origins be held liable for indirect, incidental or consequential damages.

The Customer is solely responsible for the use made of the products purchased. MARAZ Origins cannot be held responsible for inappropriate use or contrary to the care instructions provided.

In case of force majeure (natural disaster, war, strike, epidemic, etc.), MARAZ Origins will be released from any liability for non-performance or delay in performance of its obligations.

10. Personal data

MARAZ Origins collects and processes your personal data in compliance with the General Data Protection Regulation (GDPR) and applicable Senegalese data protection laws.

The data collected (name, address, email, telephone, payment information) is necessary for processing and delivery of your order, as well as customer relationship management.

Your data is kept for the time necessary for the purposes for which it was collected, in accordance with our legal obligations. It will never be sold or rented to third parties for commercial purposes.

You have the right to access, rectify, erase, limit, port and object to your personal data. To exercise these rights, contact us at privacy@marazorigins.com.

11. T&C modifications

MARAZ Origins reserves the right to modify these T&C at any time to adapt them to changes in the site, legislation or our business practices.

The new T&C will be applicable as soon as they are posted on the site. We encourage you to regularly consult this page to learn about any modifications.

The T&C applicable to your order are those in effect at the time of order validation. A copy of the accepted T&C is sent to you by email with the order confirmation.

In case of substantial modification, we will inform you by email and/or by a notification on the site. Continued use of the site after these modifications constitutes acceptance of the new T&C.

12. Applicable law and disputes

These T&C are governed by Senegalese law. Any dispute relating to the interpretation or execution of these will be submitted, failing amicable resolution, to the competent Senegalese courts.

Before any legal action, we invite you to contact us to attempt to resolve the dispute amicably. Our customer service is at your disposal at contact@marazorigins.com.

In accordance with the provisions of the Consumer Code, the Customer may also resort to mediation in case of dispute. We undertake to participate in good faith in any mediation procedure.

If any provision of these T&C is deemed invalid or unenforceable, the other provisions will retain their full force and effect.
